The Agreement

Other than making information from third parties obtainable for you, introducing you to third party providers of goods and services, Esteem Aesthetics Pty Ltd, Esteem Cosmetic Studio Pty Ltd, Esteem Cosmetic Studio Brisbane, Breast Implant Removal Australia (BIRA) is not providing you with any goods or services in the capacity of a principal. Third party principals, not sub-contractors to Esteem Aesthetics Pty Ltd, Esteem Cosmetic Studio Pty Ltd, Esteem Cosmetic Studio Brisbane, Breast Implant Removal Australia (BIRA) provide all goods and services to you. Neither Esteem Aesthetics Pty Ltd, Esteem Cosmetic Studio Pty Ltd, Esteem Cosmetic Studio Brisbane, Breast Implant Removal Australia (BIRA) nor any of its officers, employees or directors are doctors, dentists or otherwise qualified to provide information in relation to any medical procedure.
Your Representation to Esteem Aesthetics Pty Ltd
You distinctively represent and certify to Esteem Aesthetics Pty Ltd, Esteem Cosmetic Studio Pty Ltd, Esteem Cosmetic Studio Brisbane, Breast Implant Removal Australia (BIRA) that you accept and are solely responsible for these risks and will not hold Esteem Aesthetics Pty Ltd, Esteem Cosmetic Studio Pty Ltd, Esteem Cosmetic Studio Brisbane, Breast Implant Removal Australia (BIRA) or its officers or employees responsible in any way you use those services solely at your own risk. That you have obtained or been advised by Esteem Aesthetics Pty Ltd, Esteem Cosmetic Studio Pty Ltd, Esteem Cosmetic Studio Brisbane, Breast Implant Removal Australia (BIRA) to obtain independent medical advice from an appropriately qualified medical practitioner in relation to any medical services that you have asked Esteem Aesthetics Pty Ltd, Esteem Cosmetic Studio Pty Ltd, Esteem Cosmetic Studio Brisbane, Breast Implant Removal Australia (BIRA) to coordinate on your behalf.
You acknowledge that Esteem Aesthetics Pty Ltd, Esteem Cosmetic Studio Pty Ltd, Esteem Cosmetic Studio Brisbane, Breast Implant Removal Australia (BIRA) has not given you any counsel or gestured any opinion that a rational person would deem as being an advice or opinion of a medical nature (including with respect to any likely results, risks, and side effects or otherwise). Even though Esteem Aesthetics Pty Ltd, Esteem Cosmetic Studio Pty Ltd, Esteem Cosmetic Studio Brisbane, Breast Implant Removal Australia (BIRA) may have provided information regarding the availability of medical services or coordinated medical procedures, products or other services on your behalf, Esteem Aesthetics Pty Ltd, Esteem Cosmetic Studio Pty Ltd, Esteem Cosmetic Studio Brisbane, Breast Implant Removal Australia (BIRA) takes no responsibility whatsoever and excludes all liability for the actual medical services provided.
Third Parties
Esteem Aesthetics Pty Ltd, Esteem Cosmetic Studio Pty Ltd, Esteem Cosmetic Studio Brisbane, Breast Implant Removal Australia (BIRA) employs every reasonable care in the selection of third parties that you are presented to and who may provide goods and services to you in association with a surgical or a non surgical procedure. Third Parties are independent of Esteem Aesthetics Pty Ltd, Esteem Cosmetic Studio Pty Ltd, Esteem Cosmetic Studio Brisbane, Breast Implant Removal Australia (BIRA). Third parties provide medical services or other agreed products to you. It is recommended that you check each third party service provider's terms and conditions which apply to the goods or services they provide. You must ensure that you are aware of any exclusions or limitations of liability impressed by the service provider. All or some of these may exclude or limit liability for delays, property loss or damage, personal injury or even death. Apart from any condition or warranty entailed by law which cannot be excluded. Esteem Aesthetics Pty Ltd, Esteem Cosmetic Studio Pty Ltd, Esteem Cosmetic Studio Brisbane, Breast Implant Removal Australia (BIRA) does not make any sanctions or statement or representation relating to the goods or services provided to you under this Agreement, whether by Esteem Aesthetics Pty Ltd, Esteem Cosmetic Studio Pty Ltd, Esteem Cosmetic Studio Brisbane, Breast Implant Removal Australia (BIRA) or a Third Party.
Exclusion of Liability
Esteem Aesthetics Pty Ltd, Esteem Cosmetic Studio Pty Ltd, Esteem Cosmetic Studio Brisbane, Breast Implant Removal Australia (BIRA) does not accept any liability in contract or in tort for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by unanticipated or uncontrollable event or effect on our part or directly or indirectly in connection with any surgery or non-surgical service organised by Esteem Aesthetics Pty Ltd, Esteem Cosmetic Studio Pty Ltd, Esteem Cosmetic Studio Brisbane, Breast Implant Removal Australia (BIRA) on your behalf. You agree to release, defend and hold harmless Esteem Aesthetics Pty Ltd, Esteem Cosmetic Studio Pty Ltd, Esteem Cosmetic Studio Brisbane, Breast Implant Removal Australia (BIRA) and its officers and employees and agents from all such liability and indemnify each of them severally against any such claims that may be made by or through you related to your breach of this Agreement or use of our website in any manner.
